What is the debt collection process in Anguilla?
There is no one specific procedure. In the case of debt collection cases accruing under the terms of a contract the course taken will be dictated by the terms of the contract, if any. Otherwise, the customary process followed in the usual course of events is: a first demand is made giving the debtor say 14 / 21 days within which to settle the debt or enter into arrangements to settle.
If there is no progress, a further demand is made giving say 7 days to settle, failing which steps will be initiated without further reference to the debtor. These steps are evidence to the court that a reasonable effort to recover was made prior to the filing of a claim.
If local parties are involved there is a 10% collection fee added to the outstanding amount.
If the creditor is an international person/entity then the collection fee added to the outstanding amount is 20% of the debt or a negotiated amount (not less than 10%).
Average length of time to collect a debt?
This will depend upon the circumstances of each case.
If the creditor takes the decision to file a claim: A claim form and Statement of Claim (or Affidavit in Support of Claim) is filed.
If there is no defence to the action and funds are available to settle, a claim can be satisfied within weeks/months.
If however, a defence is filed, there are various applications filed, and the matter goes to trial a resolution could take years.
Can late payment fees / interest to be added to claims?
.Yes; late payment fees and interest can be added if included in the terms of a contract. Otherwise, statutory interest may be recovered at the rate of 5% per annum from the date of the entry of judgment.
